Sales Ageement & Contract

  1. REGISTRATION AND OWNERSHIP TRANSFER

After the Buyer pays the Purchase Price in full, the seller shall transfer ownership of the dog to the Buyer.

  1. MEDICAL CONDITIONS AND MEDICATIONS

The Buyer has been advised that the dog has no known medical conditions/medications.

  1.  BUYER’S RESPONSIBILITIES

The buyer agrees to give the dog the best care both physical and emotionally.  Buyer will never sell or give the dog away to any pet shop, pet farm, puppy mill, or any other similar situation.  The buyer agrees to provide a clean, healthy, spacious, securely fenced, safe environment.  This environment should include plenty of human companionship, regular exercise/play, a nutritionally sound diet, timely veterinarian care, proper deworming and kept up to date on vaccinations schedule for the above specified dog.

  1. ONE-YEAR HEALTH WARRANTY

The Seller warrants the puppy for one year of age against all life-threatening congenital or hereditary defects, untreatable conditions only.  If the dog is found to have a life-threatening genetic or congenital defect that is not treatable within the first year of life, a replacement puppy of equal price will be given to Buyer if and ONLY if the following conditions are met:

  1. The puppy is diagnosed by a certified veterinarian and by the Seller’s veterinarian.

  2. No shots, deworming are administered during the first 48-hour period of the Buyer taking possession of the dog.

  3. If living, the original dog is returned to the Seller at the Buyer’s expense.  The Buyer is responsible for any shipping fees for the replacement dog.

  4. In the event of death, an autopsy must be performed, and a lab report performed to determine the cause of death.  This is to be done by a licensed veterinarian of the Seller’s choice.

  5. The dog has not been abused in any way.  If it is found that the dog was abused in any way this warranty is void.

No money refunds will be given.  If the replacement dog is a higher price than the purchased dog, the Buyer will be responsible for the difference, or may wait for a puppy to be born of the same price.  This warranty is valid until the dog turns one year of age.

  If a replacement dog is provided, the terms of this bill of sale will apply to that dog, and all references to the dog herein shall be taken to mean the replacement dog.

Seller is not responsible for any medical expenses that arise once the Buyer takes ownership of the dog. Although the dog has been vaccinated with DHPP, no guarantee is given on any dog if any shots or deworming are administered during the first 48-hour period of Buyer taking possession of the dog.  This warranty cannot be transferred to a third party.

 

Seller is not responsible for any death due to hypoglycemia, dehydration, internal or external parasites/bacteria/viruses or any other illness that could have been prevented by the new owner.  Disorders that may be caused by environmental factors are not covered under this warranty, nor are uneven bites or hernias.  Examples of these disorders include parasitic infestations, coccidia, kennel cough, demodectic mange, scabies, growths, allergies, thyroid dysfunction, and other autoimmune system maladies.  These are not life-threatening ailments and are treatable.

 

Yorkshire Terriers can dramatically change their color, size, weight, and appearance as they grow and mature.  The Seller can give an approximation as to the size and color the dog is going to be when full grown.  The Seller gives no guarantee regarding size, weight, or color of the dog.  There is NO guarantee written or implied, as to the adult size of the dog, show potential, ear size or positioning, coat quality or temperament.  This puppy is being sold as pet quality only, even when breeding rights are given.  There is no guarantee against breeding soundness, sperm count/quality, females coming into heat, or reproducing.  Parti Paw Yorkies strives to improve the quality of the breed and endeavors to produce health, happy puppies; however, there is no guarantee against non-life-threatening conditions common to the breed such as luxating patella due to the many factors and causes of said condition (i.e. injury or improper care.)

 

  1. RIGHT OF RECOVERY OR PLACEMENT

 

Should the Buyer find him or herself in a circumstance that prevents him or her from being able to properly care for the puppy.  Buyers agrees that the puppy will NOT under any circumstances ve place in a dog pound or rescue center (this provision is to ensure that the puppy will not end up abused, homeless or destroyed).  Buyer agrees to contact Seller if they find themselves unexpectedly in a circumstance that prevents them from caring for the puppy.  In such cases, Seller will recover the puppy and care for the dog until a new loving home is found and the puppy is successfully placed.  Under no circumstances may the Buyer sell, lease, or give the dog to any pet shop, research laboratory, or similar facility (including dog pounds or rescues).  If the Buyer can no longer provide a home for the puppy, the Buyer shall notify the Seller before making any transfer and the Seller shall help find a new home for the puppy or reclaim the puppy at the Buyer’s expense.  If the puppy is returned under this section, the Buyer shall help with any legal action necessary to transfer ownership and registration of the puppy to its new owner.

 

  1. NO REPRESENTATIONS OF FUTURE ABILITIES

The Seller has made no representations, verbal or implies, about the dog’s future abilities.

  1. GOVERNING LAW

This contract contains the entire agreement between the parties and no statement, promises, or inducements mad by either party that is not contained shall be valid or binding.  This contract may not  be modified or altered.  No refunds will be given, all deposits are non-refundable, and all sales are final.

This agreement is governed by the laws of the United States and the state of California.  All disputes are subject to resolution in the Seller’s domicile: Yuba County, California.

By purchasing this dog, you, the Buyer, agree that you have read, understand and accept the terms of this contract.
